2009 MUTCD

What is the 2009 MUTCD? The 2009 Manual on Uniform Traffic Control Devices (MUTCD) is currently not in effect and is under review. It was posted to the Federal Register on January 2nd, 2008 and when it is finalized, pending the final issue is not dramatically changed; it will significantly effect occupational high visibility safety apparel usage.

What will Change from the 23 CFR Part 634?

The CFR will be absorbed into the MUTCD and will be discontinued making the MUTCD the primary document federally regulating the use of high visibility safety apparel for workers.

The MUTCD will take the mandatory use of Class 2 or greater garments from federally aided roadways to all roads that are open to public travel. This means that any road where a vehicle can be driven without having to pass through a traffic control gate, even on private property. The MUTCD will even effect private property that does have a traffic control gate because if that gate is left open or the incoming traffic is not regulated, anyone working beyond that gate must have a class 2 or greater garment.

It is also being recommended that ANSI-207 compliant vests be added as an option to the MUTCD to be worn by public safety personnel.

Important Note:

Until the MUTCD is put into effect, there will be some gray areas in the differences between the CFR & MUTCD
